An application u/o 1 rule 10 of CPC has been filed on
behalf of Defendant no. 3 seeking deletion from array of parties. Copy
of the same be supplied to Ld. counsel for plaintiff.
Reply to the application be filed within a period of four
weeks from today with advance copy to the opposite side.
Perusal of the record reveals that vide order dated
16.01.2026, notice of the application u/o 1 Rule 10 of CPC was
directed to be issued to proposed Defendant no. 4, on filing of PF,
however, the same was not issued as steps were not taken on behalf of
plaintiff.
Issue fresh notice of the application u/o 1 Rule 10 of CPC
to the proposed defendant, on filing of PF/RC/Speed Post/Courier as
well as through approved electronic modes, returnable for NDOH.
Steps be taken within 15 days from today.
WS filed on behalf of the defendant No.3. Copy of the
same be supplied to Ld. counsel for plaintiff.
It is submitted by Ld. counsel for defendant No.3 that he

will an appropriate application seeking condonation of delay in filing
the WS on or before the NDOH with advance copy to the opposite
side.
Put up for consideration on application u/o 1 Rule 10 of
CPC and further proceedings on 25.07.2026.
