Ld. Counsel for the plaintiff submits that he has e
filed an application u/o 6 rule 17 CPC for amendment of the
plaint and that he will file the hard copy during the course of the
day.
Ld. Counsel for the defendant has objected the same
on the ground that the matter is pending for arguments on
maintainability since August 2025 and the plaintiff is merely
trying to delay the matter. He further submits that cost must be
imposed upon the plaintiff for repeated adjournments.
Today the matter is listed for arguments on
maintainability. From last three dates of hearing adjournments
have been taken by the plaintiff for advancing the arguments and
today it is submitted by the plaintiff that he has efiled an
application u/o 6 rule 17 CPC for amendment of plaint but no
hard copy has been filed nor any advance copy of the application
has been supplied to the opposite party.

In these circumstances, the court considered deems
fit to impose cost of Rs. 2000/ on the plaintiff payable to
defendant for delaying the matter.
Plaintiff is directed to supply the copy of application
u/o 6 rule 17 CPC to the opposite party today itself.
Reply, if any, be filed by NDOH with advance copy
to the opposite party.
