lastly arose on 14.07.2021 whereafter suit should have been filed within
limitation i.e. 3 years from 14.07.2021.
Applying the abovesaid order, since actual period of limitation
from 01.03.2022 for the present case is more than 90 days, the remaining
period which is more than two years and 4 months shall apply and no
additional extension of limitation period was granted by Hon’ble Apex
Court in such cases.
In view of the above discussion, the present suit has been filed
beyond the period of limitation. Accordingly, the plaint is rejected u/o VII
rule 11 (d) CPC being barred by law.
Decree sheet be prepared accordingly.
File be consigned to Record Room.
