Perusal of the
Shapath Patra on the basis of which
present suit has been filed u/o XXXVII CPC states that defendant
sometime paid the amount and sometime did not pay the amount.
For the purpose of order XXXVII CPC the due amount
has to be a liquidated sum. However, in the
Shapath Patra, there is a
mention of a loan of Rs 1,50,000/- and further amount of Rs
80,000/-. In the opinion of the court, the
Shapath Patra does not
show a liquidated sum as the amount paid by the defendant has not
been accounted for.
Ld. Counsel for the plaintiff has sought time for
addressing arguments on leave to defend.
