One Ms. Neelam Saini, advocate, has appeared through VC for plaintiff
without turning her camera on. Such appearance is neither permissible nor appreciated.
She is expected to remain present in person on NDOH to clarify her conduct.
Fresh vakalatnama filed on behalf of proposed defendant Ms. Ruchi Garg.
Same be checked and taken on record.
Request for adjournment is made on behalf of proposed defendant Ms.
Ruchi Garg on the ground that she needs to file a response. However, upon query, Ms.
Khushbu Kalra, Ld. Counsel for proposed defendant has duly submitted that Ms. Ruchi
Garg is the owner of property no. L-16 in respect of which the relief has been sought by the
plaintiff. Accordingly, it is quite apparent that owner of such property would be a
necessary party to the present suit, without whom no effective adjudication can be carried
out.
Accordingly, Ms. Ruchi Garg is hereby impleaded as defendant no.3 in the
present suit under Order I Rule 10 CPC.
Application under Order I Rule 10 is allowed and disposed off accordingly.

Application filed by the plaintiff under Order VI Rule 17 CPC for formal
changes in the plaint regarding the numbering of the defendants is also pending
adjudication. Heard.
With the aforesaid directions, the application filed by the plaintiff under
Order VI Rule 17 CPC is also disposed off.
Let the amended memo of parties alongwith amended plaint whereby the
newly impleaded defendant/owner Ms. Ruchi Garg shall be defendant no.3, be placed on
record within a week from today by the plaintiff. Spare copy thereof be released to newly
impleaded defendant no.3.
Let the written statement be filed by defendant no.3 within 30 days from date
of such service with advance copy to the opposite side.
Be adjourned for arguments on interim application as well as for framing of
issues and examination of parties for 16.12.2026.
The concerned official of the MCD who is well aware about the facts and
circumstances of the case shall remain present in person on the NDOH.
