Present: Plaintiff (Through VC)
The suit has already been proceeded ex-parte qua the defendant.
Vide a separate judgment of even date, suit of Plaintiff is decreed in
the following terms :-
(i) A decree of possession is passed in favor of the plaintiff and the defendant is
hereby directed to handover the vacant and peaceful possession of suit property,
ie, Ground Floor, 197, Parmanand Colony, Delhi-9.
(ii) A decree of recovery of money of Rs. 43000/- towards arrears of rent/mesne
profits as claimed in para B of prayer clause along with interest @ 6% pa till
getting the physical possession of the suit property. Plaintiff is further entitled
for a decree of arrears of rent / mesne profit @ Rs 18700/- from August 2024 till
the handing over of the possession of suit property along with interest @ 6% pa
from August, 2024 till the handing over of the possession of suit property.
Further, plaintiff is directed to make the payment of court fee as per the
calculation of rent / mesne profit @ 18700/- from August 2024 till the date of
decree.
(iii) Decree for a sum of Rs. 17980/- towards arrears of electricity and water
charges in respect of the suit property.
(iv) A decree of permanent injunction in favor of the plaintiff and against the
Defendants thereby restraining the Defendants not to deliver the possession of
the suit property, ie, Ground Floor, 197, Parmanand Colony, Delhi-9 in any
manner to anyone except the plaintiff.
(v) Costs of the suit are also awarded in favor of the plaintiff.
Decree sheet be prepared accordingly after receiving deficient court
fee from the plaintiff.
File be consigned to record room after due compliance.
