None for defendant no.2.
Defendant no.1 has not been served.
Summons issued to defendant no.2 received back
served upon the sister of defendant no.2.
Summons issued to defendant no.1 has been received
back with the report that defendant no.1 is in JC.
Ld. Counsel for plaintiff submits that he shall move
appropriate application for service of summons and production of
defendant no.1.
At this stage, Ld. Counsel for plaintiff has pressed for
passing an order for status-quo with respect to the possession of the
plaintiff over the suit property. In order to show his possession, the
plaintiff has placed on record documents of property (sale deed) in
favour of one Sunil Kumar Khatri who had executed GPA etc. in favour
of the plaintiff. The plaintiff has further placed reliance on the
electricity bill which is in the name of plaintiff with respect of the suit
property i.e. plot in Kh. No.94/3, Village Alipur, Delhi-36. The
plaintiff has further placed reliance on the FIR registered on the
complaint of plaintiff against the defendants.
Considering the circumstances of the case, the
defendant no.2 and any person claiming through him are directed
not to dispossess the plaintiff from the suit property till the NDOH.
Defendant no.2 is directed to file WS as well as reply
to the application U/o 39 rule 1 and 2 CPC.
At request, be put up for further proceedings on
03.09.2025.
Copy of this order be given dasti as prayed for.
