plaintiff
Ms. Mandeep Kaur, Ld. LAC for defendant-3 (Through VC) and
Defendant-2 and 3 in person.
None for the defendant-1.
Authority letter on behalf of the Defendant-2 be filed during the
course of the day.
It is submitted by Ld. LAC for Defendant-3 that the case has
been marked to her day before yesterday and she seeks some time to file WS.
Let the same be filed by NDOH with application for condonation of delay
which shall be decided on its own merits.
It is submitted by Defendant-3 that D-1 is in judicial custody
since 19.08.2025 and further that D-1 is an indigent person and is not in a
position to engage a counsel. He has been apprised of Legal Aid Service and
has been advised to approach Ld. Secretary, DLSA, Rohini Courts, Delhi.
At this stage, it is submitted by Ld. Counsel for plaintiff that
Defendant-2 and 3 both are continuously trying to trespass over the suit
property which is in the possession of Plaintiff. It is admitted by D-2 and 3
that the Plaintiff is in possession of suit property, ie, Property no. 9-F, Area
measuring 78 sq yards, Kh. No. 290/2, Auchandi Road, Near Shiv Mandir,
Bawana, Delhi-110039. Considering the submissions, parties are directed to
maintain status quo till NDOH. Put up the matter for filing of WS on
29.01.2026.
