Process in terms of previous order received back unserved with the report of no such person as informed by servants who did not disclose their names and further stated that this property belongs to one Suresh. It is submitted by Ld. Counsel for DH that JD is deliberately avoiding the process and he is the owner of property as mentioned in amended memo of parties which can be verified from the khata record that the property khasra no. 268 (18-0), khatoni khata no. 1391/533 in Village Shahbad Daulatpur, Delhi belongs to JD. It is further submitted that JD has accepted the process by way of affixation in many other executions against him. He further requested that warrant of attachment of immovable property of JD may be issued in order to satisfy the decretal amount. However, Perusal of the nazir report shows that affidavit regarding stay or appeal and list of goods not filed on behalf of the DH. Accordingly, DH is directed to file affidavit regarding no stay or appeal and list of goods of movable properties. Put up the matter for further proceedings on 10.04.2026.
