WS has been filed on behalf of defendants
along with reply to the application U/o 39 rule 1 and 2 CPC.
Same be taken on record. Copy supplied.
At this stage, Ld. Counsel for plaintiff has
pressed for passing an order of status-quo with respect to the
suit property bearing No.D-1280, situated at New Sabji
Mandi, Azadpur, Delhi. It is stated that the defendants be
directed not to dispose of the property till the disposal of the
suit. As regards the other reliefs claimed in the application,
the Ld. Counsel for plaintiff has submitted that the
application be heard on the NDOH.
Ld. Counsel for defendants has submitted that
the defendants are not creating any third party interest in the
suit property and are running their business from the same. It
is further stated that the defendants are in the possession of
the suit property and the plaintiff may be directed not to
disturb the possession of the defendants. It is stated that a
counter claim has also been filed, though, the same is yet to
be registered.
Ld. Counsel for plaintiff, on inquiry has
admitted that the defendants are in possession of the suit
property.

In the circumstances of the case, the parties are
directed to maintain status quo with respect of the possession
and title of the suit property till the NDOH.
An application U/o 7 rule 10 and 11 CPC has
also been filed on behalf of defendants. Same be taken on
record. Copy supplied.
Reply to the same be filed before NDOH with
advance copy to the opposite party.
Be put up for arguments on the application U/o
39 rule 1 and 2 CPC and application U/o 7 rule 10 and 11
CPC on 08.12.2025.
