Present: Sh. , Ld. Counsel for the plaintiff with plaintiff.
All the defendants in person.
Summons issued received back duly served on 17.02.2024.
It is submitted that the correct name of wife of D-2 Sachin
Ekka is 'Karishma' and not 'Krishna'.
Ld. Counsel for plaintiff is directed to file amended memo.
Defendants submit that they have not engaged any counsel yet.
defendants are directed to file WS within stipulated time along with the
reply to application u/o 39 Rule 1 & 2 CPC.
Ld. Counsel for plaintiff submits that plaintiff resides in the
suit property along with her brothers i. e. the defendants, however
defendants are trying to dispossess the plaintiff from the suit property.
Defendant present in person submits that the plaintiff is
already married and only some articles belonging to her are kept at the suit
property, however, the father is the owner of the property.
Ld. Counsel for plaintiff argues that temporary relief be given,
directing the defendant not to dispossess the plaintiff from the suit property.
Now to come up for 03.06.2024.
It is to be noted that the interim relief so prayed by the plaintiff
is same as of the relief sought in the main suit. As per settled proposition
of law, the same cannot be granted.
