Perusal of record shows that the present case
was treated as ordinary recovery suit from suit U/o 37 CPC
vide order dated 21.11.2025 and summons for settlement of
issues were ordered to be issued vide order of even date.
Further, on 16.03.2026 the summons were received back
improperly served and order of issuance of fresh summons
was passed but due to typographical error, order of issuance
of summons U/o 37 CPC was typed in the order sheet dated
16.03.2026. However, ordinary summons were issued for
today i.e. 15.07.2026.
The summons issued against the defendant has
been received back served through one Surjeet who stated
himself to be the supervisor of the defendant firm, on
26.05.2026. No WS has been filed on behalf of defendant.
The stipulated period for filing of WS has already lapsed.
Accordingly, right of the defendant to file WS stands
closed.
