Record is perused carefully.
Pleadings are complete. After going through the
pleadings and hearings following issues are framed for trial :
1. Whether a sole distributor agreement was executed
between the plaintiff and the defendant ? OPD
2. If issue no.1 is decided in affirmative, whether the
said agreement was violated by plaintiff and defendant
offered to return the goods lying with the defendant ?

3. Whether the plaintiff is entitled to the recovery of
Rs.2,17,310/- with pendente lite and future interest ?

4. Relief, if any.
No other issue is arising or pressed upon by the
parties.
As the initial issues are to be proved by defendant,
the defendant is directed to lead evidence first as per Order 18
CPC. Let the list of all the witnesses be filed within 15 days
from today. Affidavit of all the DWs be also filed by the
defendant after supplying the copies to the opposite counsel in
advance.
