Present : Ld. counsel for plaintiff, Ms. Nishu Budhiraja along with
plaintiff.
Ld. proxy counsel for defendant No.1, Sh. Abhishek.
None for defendant No.2.
Matter is fixed today for further proceedings.
It is submitted by Ld. proxy counsel for defendant No.1
that main counsel is not available today as he is out of station.
Perusal of record reveals that on the LDOH, defendant
No.1 was directed to appear in person.
Today neither the defendant No.1 has appeared nor main
counsel for defendant No.1 has appeared before the court.
It is submitted by Ld. proxy counsel for defendant that
main counsel and defendant No.1 are unable to appear before the court
due to personal difficulty.
It is submitted by Ld. counsel for plaintiff that the
plaintiff and PW2 are senior citizens and the defendant is deliberately
delaying the present case in order to harass the plaintiff.
It appears that the defendant is deliberately avoiding
appearance before the court in order to delay the proceedings of the
present case as the reason for non-appearance of both D1 as well as
her counsel is stated to be personal difficulty without any further
explanation regarding the same. Also, the date was given as per the
request and convenience of both the parties.

Accordingly, the opportunity of the defendant No.1 to
cross-examine PW2 stands closed.
Cost of Rs. 2000/- is imposed upon to D1 to be paid to
the plaintiff on or before the NDOH for failure to comply with order
dated 28.10.2025.
Issue summons to witnesses mentioned at serial no. ii, iii
and iv in the list of witnesses on filing of PF within 15 days from
today.
Put up for PE on 13.01.2026.
