Matter is fixed today for PE.
An application u/o 28 Rule 17 of CPC has been filed on
behalf of defendant seeking recalling of PW2 for the purpose of cross-
examination.
It is submitted by Ld. counsel for plaintiffs that she has
received instructions from the plaintiffs that they have no objection if
PW2 namely, Bimla Manchanda is dropped from the list of witnesses.
Separate statement of Ld. counsel for plaintiffs, Ms.
Nishu Budhiraja has been recorded.
In view of the statement of Ld. counsel for plaintiffs, Ms.
Nishu Budhiraja, PW2 Ms. Bimla Manchanda is hereby dropped from
the list of witnesses.
In view of statement of Ld. counsel for plaintiffs, afore-
mentioned application filed on behalf of the defendant has become
infructuous. Same is accordingly disposed of.
PW HC Raj Kumar examined in chief as PW3, cross-
examined and discharged.
Issue summons to witnesses mentioned at serial no. 2, 4,
5, 6 and 7 in the list of witnesses on filing of PF within 15 days from
today.

Cost of Rs. 2000/- imposed vide order dated 19.12.2025
has been paid by defendant No.1 to the plaintiff today in court.
Joint request has been made for referring the present
matter to Mediation Center on the ground that there are chances of
compromise/settlement.
In view of aforesaid submissions made by Ld. Counsel(s),
the parties are directed to appear in Mediation Center on 27.01.2026 at
2.00 PM.
Put up for report of mediation and PE on 28.02.2026.
