Present : Ld. counsel for plaintiff, Sh. R.R Saini along with
plaintiff.
Ld. counsel for defendant, Sh. Vivek Sansalwal along
with defendant.
Matter is fixed today for appearance of defendant.
It is submitted by Ld. counsel for defendant that he has not
been supplied with the copy of allotment letter dated 17.08.1976 filed on
behalf of the plaintiff on the LDOH, therefore, he was unable to file WS.
An application u/o 8 Rule 1 of CPC has been filed on behalf
of defendant seeking extension of time for filing the WS on the
aforementioned ground.
It is submitted by Ld. counsel for plaintiff that he has no
objection if the said application is allowed.
In view of the submissions, application u/o 8 Rule 1 of CPC is
allowed. Defendant is granted time of one week for filing the WS.
Ld. counsel for plaintiff has undertaken to supply copy of
allotment letter to Ld. counsel for defendant during the course of the day.
WS be filed within a period of one week from today with
advance copy to opposite side.
Replication, if any, be filed within four weeks thereafter with
advance copy to the opposite side.
Put up for further proceedings on 03.03.2026.
