Perusal of the record reveals that interim application filed by the plaintiff under Order XXXIX Rule 1 and 2 CPC is pending adjudication, whereby plaintiff has sought injunction against the defendants restraining them from further demolishing or carrying out any construction work in the suit property i.e. 34 & 52, Village Sarai Pipal thala, Land Mark near Peer Baba, Delhi-110033 and property no. 35, Village Sarai Pipal Thala, Land Mark near Peer Baba, Delhi-110033, till the pendency of the present suit. Ld. Counsel for plaintiff submits that he does not wish to press the aforesaid application. Heard. Accordingly, the interim application filed by the plaintiff under Order XXXIX Rule 1 and 2 CPC is hereby disposed off as not pressed. PW-1 cross-examined on behalf of defendant no.3/MCD. Mr. Yogi Bahal, Ld. Counsel for defendant no.1 and 2 has sought an adjournment on the ground that his father currently hospitalized at Faridabad and he has to rush there for his discharge. Heard. Not opposed. Allowed for today. PW-1 shall remain bound down for NDOH. -- 1 of 2 -- Be adjourned for cross-examination of PW-1 on behalf of defendants no.1 and 2 for 18.01.2027.
