After going through the pleadings and hearings
following issues are framed.
1. Whether the defendants have encroached into the
portion of the plaintiff by placing iron garter on the wall of
the plaintiff? OPP
2. Whether plaintiff is entitled to the relief of permanent
injunction to the effect that defendants be restrained from
raising any further illegal construction on the suit property?

3. Whether the plaintiff is entitled to the relief of
mandatory injunction in the form of direction to defendant
no.1 and 2 to remove the iron garter from the wall of the
plaintiff? OPP
4. Whether plaintiff is entitled to the relief of mandatory
injunction in the form of direction to defendant no.3 to
demolish the unauthorised construction raised by defendant
