Present : Mr. Adamya Pal Singh, Ld. Counsel for plaintiff.
The earlier processes qua the defendant have been received
back with the report that his brother stated that he is no longer residing at
the given address and works in Bangalore. However, he did not provide the
current address of the defendant.
This being a last known address of the defendant available
with the plaintiff and considering that the family members of the defendant
did not furnish his current address, let fresh summons be issued in the
prescribed proforma by way of all available modes including electronic
modes on filing of PF/RC/speed post/Registered AD for 13.08.2025.
PF to be filed within one week from today.
Summons be also issued by way of e-mail as well as Whats
App on filing of necessary details in this regard. In case of service by Whats
App, the screenshot of the delivery of summons be placed on record
alongwith prima facie proof of the fact that the mobile number belongs to
the defendant. Certificate under Section 65-B Indian Evidence Act be also
filed alongwith screen shot reflecting such service.
In case of service by e-mail, Certificate under Section 65-B
Indian Evidence Act and print out of the dispatched e-mail be also filed.
The Process Server is also directed to affix copy of plaint and
summons at some conspicuous part of the address of the Defendant in case
of refusal/premises found locked, as per rules.
In case of service by way of affixation, Process Server is also
directed to file photographs of affixation.
