way of assignment. It be checked and registered.
Present: Sh. R K Paliwal, Ld. Counsel for the petitioner.
Ld. counsel has submitted that respondent no. 8 may be
restrained from releasing the FD amount to respondent no. 2 & 3.
It is stated that respondent no. 2 & 3 are nominee of the
deceased, however, petitioner and respondent no. 2 to 7 are class I
heirs of deceased.
Considering the submissions of ld. counsel, respondent
no. 8 is hereby restrained from releasing the FD amount to respondent
no. 2 & 3 till the disposal of the suit.
File perused. Heard.
a) General public be informed by way of publication in a
newspaper (on deposition of publication charges) having circulation
in the area where the deceased lastly resided.
b) Issue summons to concerned SDM for verification of
the status of the LRs of the deceased.
Issue notice of petition to respondents on filing of PF, RC
& Speed Post, for the next date of hearing.
Steps be taken within one week. Now to come up on
02.09.2025 for further proceedings.
Copy of this order be given dasti to the petitioner for
compliance.
