Application filed by ld. Counsel for plaintiff U/s 151 CPC for transferring
the case to the court of ld. Senior Civil Judge Sh. Virender Singh. Perused. Argument
heard.
It is submitted that by the ld. Counsel for plaintiff that one connected suit
titled as Pradeep Vs. Ravinder Dagar is pending in the court of Sh. Virender Singh, Ld.
SCJ, North, Rohini Courts. It is further submitted that plaintiff had moved application
U/o 1 rule 10 CPC for impleadment in above case titled as Pradeep Vs. Ravinder Dagar
which was allowed by Hon’ble court of Ld. SCJ North, Rohini, Delhi, However, the
operation of above order was stayed by the Hon’ble High Court of Delhi. It is submitted
by ld. Counsel for plaintiff that connected suit titled as Pradeep Vs. Ravinder Dagar is
pending before the court of Ld. SCJ and NDOH is 07.08.2023. It is further submitted by
ld. Counsel for plaintiff that as connected case is already pending before the court of Ld.
SCJ, therefore present suit be also transferred before the court of Ld. SCJ so that both
case be adjudicated together.
Submission heard.
Considering the facts and circumstance as mentioned in application as well
as after hearing the arguments, let matter be put up before Ld. District & Sessions Judge
(North), Rohini Courts, Delhi with a request to transfer this case before the court of Ld.
SCJ, North, Rohini, Delhi as connected matter is already pending in the court of Ld. SCJ,
North, Rohini, Delhi.
Plaintiff to appear before the court of Hon’ble Ld. District & Sessions Judge
(North), Rohini Courts, Delhi on 25.04.2023 at 2:00 P.M.
Ahlmad is directed to send this file to the court of Hon’ble Ld. District &
Sessions Judge (North), Rohini Courts, Delhi well before the 25.04.2023.
