Mr. Utkarsh Sharma, Ld. Counsel for defendant.
Ld. Counsel for defendant submits that one more opportunity may be
granted to him to file reply to the application u/o 39 Rule 1 & 2 CPC.
This court has already granted interim protection to plaintiff on
09.06.2025.
Ld. Counsel for plaintiff submits that interim order be continued.
The defendant is responsible for not filing its reply on record in time
despite directions. This court is left with no alternative except to continue the interim
order due to the non-compliance and default on pay of the defendant DDA. As a
result, the interim order to continue till next date of hearing.
Defendant is directed to file reply and WS within two weeks from today
with advance copy to the opposite side. It is made clear that in case order is not
complied again by defendant/DDA, DDA shall be liable for heavy cost.
An applicatin under Order 1 rule 10 CPC has been filed by the plaintiff.
Copy supplied.
Issue notice of said application to proposed defendant on filing of
PF/RC/Speed Post/Courier as well as through approved electronic modes for NDOH
on taking steps.
