Plaintiff is directed to file amended memo of parties within a week from
today, failing which a cost of Rs.5,000/- shall be imposed upon the plaintiff on NDOH.
Matter is listed for completion of pleadings and arguments on interim
application.
Ld. Counsel for defendants no.1 and 2 has strongly argued that the case of
the plaintiff is not maintainable as there is no cause in favour of the plaintiff.
A query was raised from Ld. Counsel for the plaintiff as to why injunction
would be issued against government authorities restraining them from inspecting
properties of the plaintiff. At this stage, Ld. Counsel for plaintiff has sought an
adjournment on the ground that main counsel Mr. Rambir Chauhan is not well.
Heard. Opposed. Allowed, subject to filing of medical documents.
It is clarified that no adjournment to either side for arguments on the
maintainability of the suit shall be granted for the NDOH.
Be adjourned for 07.10.2026.
