Present: Sh. Sumit, Ld. LAC for plaintiff with plaintiff.
Defendants are yet to be summoned.
It is submitted by the Ahlmad that on the original plaint
which was e-filed by the plaintiff the amount of damages was Rs.2.5
lakhs.
It is submitted by Ld. counsel for the plaintiff that on the
previous date of hearing he inadvertently mentioned the amount of Rs.
2.5 lakhs as Rs.1 lakh. It is further submitted by Ld. counsel for the
plaintiff that the plaintiff wishes to amend the suit and now wants to
claim damages only to the tune of Rs.1 lakh and accordingly requested
that the application U/O 6 R 17 r/w Section 151 CPC be allowed.
Arguments heard.
Record perused.
It is a settled law that the plaintiff is the master of her suit
and she can give up any part of the relief sought by her. Further,
considering that the matter is at the nascent stage, allowing such
application does not cause any prejudice to the opposite side.
Accordingly, the application stands allowed.
Amanded plaint filed by the plaintiff is taken on record.
Application stands disposed of accordingly.

Heard, Ld. Counsel for the plaintiff on summoning of
defendant.
Issue summons of the suit and notice of the application
under Order XXXIX Rule 1 and 2 CPC to the defendant in the
prescribed proforma on filing of PF/RC. Steps be taken within one week.
Let, the requisite undertaking regarding the payment of
deficient court fees, if any, in view of the circular no. F.10(1175)/COS
(HQ)/ CD/3356 dt. 31.12.2013 regarding the SLP bearing no. 3323/13
title as Govt. of NCT of Delhi Vs. Delhi Bar Association regarding issue
of court fees be filed by the plaintiff, if not already filed by the NDOH as
per rules.
Put up for report on summons/ appearance on 12.11.2025.
