respondent has submitted that this Court cannot entertain the
present application in view of Section 10 of the Contempt of
Courts Act. The Court, however, does not find merit in the
said submission, as it is a settled position of law that a
reference for civil contempt can be made by a Court, and for
such purpose, an application may be entertained.
Learned counsel for the petitioner has further
prayed that the present petition be treated as an execution
petition and sought permission to amend the pleadings
accordingly. Considering the circumstances, the petitioner is
directed to file an appropriate application seeking
amendment of the pleadings. Upon such application being
filed, the Court shall consider the prayer made today.
