Warrants of possession of suit property i.e. DDA builtup
LIG Flat No. 1006, I Floor, Block GH-1, Pocket No. 1, Sector-29,
Rohini, Delhi measuring 42 sq meters as well as warrant of
attachment of movable property be issued against the JD on filing of
PF, as per rules. Put up for appointment of Bailiff on 29.05.2026
and to Report before this Court on 28.07.2026.
DH is also directed to file an affidavit stating therein
that there is no stay on the execution petition alongwith the PF. The
affidavit be filed one week prior to the issuance of warrant of
possession.
Bailiff is also at liberty to break open the locks, if
required and obtain assistance of the SHO concerned.

Present: Sh. Kamal Mehta, Ld. Counsel for the DH via VC.
Warrant of possession and attachment received back
with report that DH has obtained the possession and DH was paid an
amount of Rs 30,000/- by the JD. However, the remaining amount is
Rs 50,000/-.
Ld. Counsel has further apprised that since the JD has
vacated the premises, he is no longer residing within the jurisdiction
of this Court whereas his permanent address is of Narela. Ld.
Counsel has submitted that remaining amount of the decree can be
satisfied with the personal obedience of the JD.
Considering the submissions of ld. counsel, issue
warrants of arrest against the JD as per rules on filing of PF and
depositing of subsistence allowances for first 15 days.
To come up for further proceedings on 15.12.2026.
