Proxy Counsel for defendant. WS has been filed on behalf of defendant along with an application seeking condonation of delay of 34 days in filing WS. It is stated in the application that as the father of the main counsel was diagnosed with Cancer and for the same reason WS could not be filed within time. The application is opposed by Ld. Counsel for plaintiff stating that the defendant had filed a suit before this court and the said suit was filed by the same counsel who has filed the WS in the present case and as such the reason cited in the application is not sufficient. Heard. Considering the fact that the medical documents are annexed with the application and the period of delay sought to be condoned is not much, the application for condonation of delay in filing WS is allowed. WS be taken on record. Replication has been filed on behalf of plaintiff. Same be taken on record. Copy supplied. Parties are directed to appear in person on the NDOH for examination U/o 10 CPC. Ld. Counsels for the parties have submitted that the parties are not willing to have their dispute settled through mediation.
