Fresh authorisation letter filed on behalf of the defendant-2. Taken on
record. Time sought to file WS. Heard. Let the same be filed within the stipulated
period.
At this stage, Ld. Counsel for plaintiff presses his application under
Order XXXIX Rule 1 and 2 CPC. However, Ld. Counsel for defendant-2 states he
has been recently engaged and has sought time to lead arguments as he needs to go
through the file. To this, Ld. Counsel for plaintiff has stated that till the
determination of application under Order XXXIX Rule 1 and 2 CPC, parties be
directed to maintain status quo till NDOH. Ld. Counsel for D-1 has filed order dated
16.04.2024 passed by Hon'ble Delhi High Court whereby Respondent no-2, Def. no.
2 herein, has been placed in possession of one room at the second floor in suit
property with NDOH being 07.10.2024 and parties have been directed to maintain
status quo. Same is taken on record. Accordingly, parties to maintain status quo till
NDOH in terms of directions of Hon'ble Delhi High Court.
However, this Court is constrained to observe the conduct of Def. no.
2 who has been repeatedly interrupting the proceedings by shouting in a loud
manner. She has repeatedly kept on shouting that she no one can stop her from
entering the suit property. She has been requested multiple times to refrain from the
same and has been apprised that in light of order dated 16.04.2024, her possession
qua the room on the second floor of the suit property is already protected by Hon'ble
Delhi High Court. However, her conduct remains the same and she has been
repeatedly shouting and interrupting the judicial proceedings. She is warned to be
careful in the future. Put up the matter for further proceedings on 19.11.2024.
