Issue summons for settlement of issues and notice of the application
under Order XXXIX Rule 1 and 2 CPC, if any, to the defendant/s in the prescribed
proforma on filing of PF/RC. Steps be taken within one week.
Let, the requisite undertaking regarding the payment of deficient
court fees, if any, in view of the circular no. F.10(1175)/COS (HQ)/ CD/3356 dt.
31.12.2013 regarding the SLP bearing no. 3323/13 title as Govt. of NCT of Delhi
Vs. Delhi Bar Association regarding issue of court fees be filed by the plaintiff, if
not already filed by the NDOH as per rules.
It is impressed upon the process server to attempt service to the
Defendant at least twice and that in case summons are served upon an adult
family member of the Defendant’s family after the pre-requisites of Order V R 15
CPC have been satisfied, the service report should expressly incorporate the fact
that summons were served upon the said family members only because the said
pre requisites were satisfied, i.e., Defendant was not present at the address
mentioned in the summons with there being no possibility of him being found
within a reasonable time at the said address and also the fact that he (the
Defendant) had no agent empowered to accept service on his behalf with an
acknowledgment of the person upon whom summons is so served to be duly taken.
In case of refusal to sign the acknowledgment, a copy of the summons be affixed
upon the conspicuous part of the house where the Defendant resides.
