A statement has been made on behalf of plaintiff
no.1 stating that she does not wish to continue the present case. In
view of the statement made, plaintiff no.1 is disarrayed from the
array of parties.
Plaintiff is directed to file amended memo of
parties.
It is submitted on behalf of defendant no.2 and 3
that they are not raising any construction in respect of lift in block
no.1,2 and 3 as it is for the residents of that block to decide and
raise construction if any. Separate joint statement of defendant
no.2 and 3 has been recorded to this effect.
It is submitted on behalf of MCD that the residents
of block no.1,2 and 3 have applied for grant of sanction for
installation of lift and the sanction has already been granted.
Let WS if any be filed on behalf of MCD before
NDOH with advance copy to opposite party.
An application U/o 1 rule 10 CPC has been made on
behalf of plaintiff. The same be kept for consideration on NDOH.
Be put up for further proceedings on 06.05.2025.
