Written submissions have been perused.
Learned counsel for the plaintiff submits that the plaintiff has
sought twofold reliefs in the present suit: firstly, a mandatory
injunction directing the defendant to rectify the incorrect
information displayed on the concerned platform; and
secondly, a permanent injunction restraining the defendant
from exhibiting any name of the park other than its official
designation.
It is urged that while the relief of rectification
may appropriately be granted by the competent authority
under the Information Technology Rules, the relief of
permanent injunction is within the jurisdiction of this Court.
Upon consideration, this Court finds merit in
the submissions advanced on behalf of the plaintiff. The
Court is in agreement with the contention that the suit,
insofar as it seeks permanent injunction, is maintainable and
within its jurisdiction.
Issue summons for settlement of issues and
notice of the application under Order XXXIX rule 1 & 2 CPC
to defendants on filing of PF/RC/Speed Post/AD for
19.08.2026. Steps be taken within 7 days.
