Present: Sh. D R Jain, Ld. Counsel for the plaintiff with plaintiff.
Sh. Sattu Yadav, proposed defendant in person.
Ld. Counsel for the plaintiff has no objection if
application u/o I rule 10 CPC qua proposed defendant is allowed.
Considering the submissions as well as averments made
in the application, same stands allowed. Defendant Sattu Yadav is
added in the array of parties as defendant no. 2.
Plaintiff is directed to file amended memo of parties.
Defendant no. 2 is at liberty to file W/S within 30 days
with a copy to opposite side.
Record shows that application u/o IX rule 13 CPC for
setting aside order dated 06.06.2024 is already pending adjudication.
Ld. Counsel for plaintiff has submitted that application
may be allowed subject to cost.
Considering the submissions of ld. Counsel, application
u/o IX rule 13 CPC (treated as application u/s 151 CPC for setting
aside order dated 06.06.2024) is hereby allowed subject to payment of
costs of Rs 1,000/- to the plaintiff on NDOH.
Defendant Iqbal is directed to file W/S within 30 days
with a copy to the plaintiff.
To come up for completion of pleadings/ admission &
denial and framing of issues on 24.11.2025.
