WS alongwith applicatin u/o 8 rule 1 CPC for
condonation of delay in filing WS and reply to application u/o 39
rule 1 and 2 CPC filed on behalf of the defendant no.2. Copy
supplied.
Ld. Counsel for plaintiff states that he has no
objection, if the said application u/o 8 rule 1 CPC is allowed
subject, to cost.
It is settled law that procedure is the hand maid of
justice. In the interest of justice and to afford an opportunity to
the defendant to contest the matter on merits. This court is of the
opinion that sufficient cause has been shown for condonation of
delay. Accordingly, application is allowed. The delay in filing
the WS is condoned subject to a cost of Rs. 500/- payable to
plaintiff by the defendant no.2.
WS is taken on record. Replication be filed within
the stipulated period.
Ld. Counsel for the defendant no. 1 submits that she
will file memo of appearance during the course of the day. Copy
of plaint and accompanying documents supplied to defendant
no. 1.
