Present: Sh. Bakshi Tajeshwar Singh, Ld. counsel for the applicant.
There is an application moved on behalf of applicant seeking
preponement of the date of hearing on the ground that six months period from the
date of order i.e. 18.09.2023 are going to lapse on 18.03.2023 and the applicant is a
senior citizen as such the date of hearing be preponed and notice be issued to
respondents on the application.
Perusal of the file reveals that the order on application for leave to
defend was passed by this court on 18.09.2023.
Considering the submission of counsel, the application is allowed to the
extent of issuing notice to the respondent and the prayer regarding the preponement is
dismissed due to following reasons.
1. Total number of working days left in this month are only 2 days.
2. Number of matter listed is approx. 50 with other miscellaneous
applications and fresh cases.
3. Court has also administrative work.
4. Total pendency of this court is around 1843 cases.

Issue notice of the application to respondent seeking review of order dt.
18.09.2023 on filing PF, RC for date fixed.
