An application u/o 8 Rule 1 of CPC seeking condonation of delay in filing of WS has been filed on behalf of defendant. It is submitted by Ld. counsel for defendant that the defendant was unable to file the WS within the statutory period as the defendant was unable to engage a counsel and could not meet the legal aid counsel appointed for her by DLSA. Per contra, it is submitted by Ld. counsel for plaintiff that the delay in filing the WS has not been satisfactorily explained, therefore, the WS may not be taken on record. In view of the averments made in the application and the submissions advanced, application u/o VIII Rule 1 of CPC filed on behalf of the defendant seeking condonation of delay in filing the WS is allowed. The delay in filing the WS is hereby condoned and WS filed on behalf of the defendant is taken on record. Application VIII Rule 1 of CPC filed on behalf of the defendant is accordingly disposed of. Rejoinder filed on behalf of the plaintiff. Copy of the same is supplied to Ld. counsel for defendant. -- 1 of 2 -- Affidavit of admission denial of documents be filed on behalf of the plaintiff with advance copy to the opposite side. Proposed issues be filed on or before the NDOH with advance copy to the opposite side. Put up for admission-denial of documents and framing of issues on 20.07.2026.
