Ld counsel for the defendant has filed the WS. Same be taken on record.
Copy is supplied.
Perusal of the file reveals that he summons issued were received back
duly served dated 17.04.2023. As such there is a delay of more than 9 months in
filing the WS.
Ld counsel for the defendant submits that he was not present on the last
date of hearing and as such he was not aware that WS has yet not been filed in the
present case.
Per contra, ld counsel for the plaintiff submits that delay in filing of WS
be allowed but subject to the cost.
Submissions heard.
Accordingly, the delay in filing the WS is allowed subject to cost of
Rs.1,000/-, to be paid to the plaintiff.
Put up for filing of replication, if any, with advance copy to other side,
admission/denial of documents and framing of issues for 10.07.2024.
