Present: Sh. Varun Parashaer, Ld. Counsel for plaintiff
alongwith AR of the plaintiff company in person.
None for defendant.
It is submitted by the AR of the plaintiff company
that the matter has been amicably settled in Mediation Cell on
13.02.2026 between the parties for a total sum of Rs. 75,000/- and
he wants to withdraw the present suit.
A separate statement of AR of plaintiff company is
recorded in this regard.
He further requested for the refund of the Court Fee.
In light of the Judgment of Hon’ble Apex Court in
The HC of Judicature at Madras, Rep. by its Registrar General v.
MC. Subramaniam & Ors. (2021) 3 SCC 560, the same is allowed
as per Section 16 of the Court Fee Act.
Ahlamad is directed to issue / furnish the necessary
authorisation in favour of the Plaintiff so as to enable him to obtain
refund of Court fees.
In view of above, the present suit stands disposed of
as settled as withdrawn.
Nothing remains to be adjudicated further.
File be consigned to Record Room after due
compliance.
