WS on behalf of defendant was filed on 10.05.2023 and Ld.
Counsel for plaintiff states she has already received the copy of the same.
Accordingly, she has requested for the framing of issues.
Admission/denial of document not pressed for. Pleadings
are now complete. Accordingly following issues are framed:-
I) Whether the plaintiff is entitled for decree of possession, as prayed
in para I of prayer clause of the plaint? OPP.
II) Whether the plaintiff is entitled for decree of Permanent
injunction, as prayed in para II of prayer clause of the plaint? OPP.
III) Whether the plaintiff is entitled for decree of Mandatory
injunction, as prayed in para III of prayer clause of the plaint? OPP.
IV) Whether the suit is not properly valued for the purposes of
pecuniary jurisdiction and court fee? OPP.
V) Whether the suit of plaintiff is without any cause of action? OPD
VI) Whether the suit is bad for non joinder of necessary parties? OPD
VII) Relief?
No other issue is pressed or arises.
Matter be taken up for PE on 21.01.2025.
Advance copy of affidavit be supplied to the opposite party
at least 10 days prior to the next date of hearing.
List of witnesses be filed by both the parties within 15 days
from today.
