At this stage, an Application u/O VI R 17 CPC filed on behalf of
the plaintiff. Since the Defendant is yet to be summoned, the requirement of
furnishing a copy of the same upon him is dispensed with. Submissions heard.
In light of the submissions made and considering the fact that
the suit is at a nascent stage, the present application is allowed and the
amended plaint is taken on record.
Heard, Ld. Counsel for the plaintiff.
Issue summons of the suit and notice of the application under
Order XXXIX Rule 1 and 2 CPC to the defendant in the prescribed proforma
on filing of PF/RC. Steps be taken within one week.

Let, the requisite undertaking regarding the payment of deficient
court fees, if any, in view of the circular no. F.10(1175)/COS (HQ)/ CD/3356
dt. 31.12.2013 regarding the SLP bearing no. 3323/13 title as Govt. of NCT of
Delhi Vs. Delhi Bar Association regarding issue of court fees be filed by the
plaintiff, if not already filed by the NDOH as per rules.
