Ld. Counsel for the Defendant no. 3
submitted that she has filed the Written Statement just
after a week of order dated 31/05/2023 i.e. on
09/06/2023 alongwith the application whereby praying
for waiver of cost imposed vide order dated
31/05/2023. Heard on the application. Record
perused. Opposed.
In crux, Ld. Counsel submitted that further
cost has been imposed vide order dated 26/07/2023
whereas the said Written Statement alongwith the said
application has already been filed/moved much before
that. The Ld. Counsel reiterated the contents of the
application. It is prayed that the cost imposed on
31/05/2023 as well as on 26/07/2023 be waived of.
It is pertinent to note that had it been in the
knowledge of the Court that the Written Statement /

said application has been filed on 09/06/2023, no cost
would have been imposed on 26/07/2023. Therefore,
the cost of Rs. 4,000/- imposed on 26/07/2023 is
hereby waived of. The cost of Rs. 5,000/- imposed
vide order dated 31/05/2023 is hereby reduced to
Rs. 2,000/-, which shall be paid to the Plaintiff by the
next date. Accordingly, the application is disposed
of. Written Statement is taken on record.
As prayed, the interim order passed vide
order dated 14/09/2023 shall further continue till the
next date.
Put up for completion of pleadings with
advance copy to opposite party / hearing on
miscellaneous application on 09/01/2024. As prayed,
order be dasti.
