Ld. Counsel for Plaintiff submitted that the suit

property may be demolished by the Defendant no. 3 –
DDA and the purpose of moving of the application as well
as the suit will be frustrated. It is prayed that interim order
whereby restraining the Defendant no. 3 from demolishing
the suit property may be passed atleast till the next date.
The Written Statement of Defendant no. 3 has not yet been
taken on record for want of payment of cost as transpired
from the order dated 26/05/2023. Considering the
submissions made, the Defendant no. 3 is hereby
restrained from demolishing the suit property by the next
date. Copy of this order be sent to the DDA / Defendant
no. 3 for the necessary intimation. Copy of order be also
dasti to the Ld. Counsel.
