defendant no. 3.
Ld. Counsel for the defendant nos. 1 & 2
submitted that it is reflected from the order dated
29/03/2023 that Written Statement has been filed for
defendant no. 2, however, the same ha snot been filed and
that she is even not inclined to file the same as she wants
to file an application under Order 1 rule 10 CPC, copy of
which is already supplied to Ld. Counsel for the plaintiff.
Same shall be filed in the Court during the course of the
day.
Ld. Counsel for the defendant no. 3 submitted
that although she has prepared the Written Statement, the
same could not be get signed by the defendant no. 3 and
that she will file the same by the next date. Objected. One
more opportunity is filed to file the Written Statement by
defendant no. 3 by the next date with advance copy to the
party, subject to cost of Rs. 5,000/- which shall be paid to
the plaintiff.
