DEACEASED THROUGH LRS.) VS. MS. BINDU
    SINGH
    16.01.2026
Present: Ms. Seema Khatri Ld. Counsel for DH.
    Nazir report is perused.
Perusal of record shows that the address of the
JD does not fall within the jurisdiction of North District,
    Delhi.
It is pertinent to mention that as per Section 39
    (4) CPC is provided that :
“Nothing in this section shall be deemed to
authorize the court which passed a decree to execute such
decree against any person on property outside the local
    limits of its jurisdiction.”
Thus, in the light of JD not residing within the
jurisdiction of the court, the present Court is restrained by
operation of Section 39 (4) CPC to execute the present
decree and the present execution petition ought to be
agitated before the court of appropriate jurisdiction.
Let Transfer Certificate be prepared. Nazir is,
hereby, directed to do the needful.
File be consigned to Record Room after due
    compliance.
