Report of court notice received back with remarks wife of the accused was found
who telephonically informed the accused about the process of the court and accepted the court
notice on behalf of the accused.
Ld. counsel for accused has prayed for an oral exemption on behalf of the
proposed accused. Allowed for today only subject to appearance of proposed accused on the
next date of hearing.
Ld. Counsel for the accused has submitted that the matter has already been settled
between the parties.
Ld. Counsel for the complainant has submitted that no such settlement has taken
place.
After hearing the submissions of the Ld. Counsel for the proposed accused, the
court is of the view that a case U/s 138 NI Act is made out against the accused.
I take cognizance in the matter.
Following the law laid down in
A. C. Narayanan Vs. State of Maharashtra &
Anr.” (2014) 11 SCC 790, complaint, affidavit of evidence and documents considered. In view
of complaint, documents produced and verification in the form of affidavit of evidence, there
are sufficient grounds for proceeding further against accused person for offence punishable
under Section 138 N. I. Act.
As the accused has appeared before the court formal issuance of summons is
dispensed with.
Ld. counsel for the complainant is directed to supply copies of complaint and
documents to Ld. Counsel for accused through whatsapp no. (9891119846) within seven days.
Ld. counsel for the complainant is directed to keep proof of supply of the copy till
the next date of hearing.
Put up for furnishing of bail bond/framing of notice on 09.12.2025.
