Present : Sh. N. K. Singh, Ld. ProxyCounsel for complainant through VC
NBW issued against the accused received back unexecuted with the report that the
accused has left the address due to heavy debt against him.
Perusal of the report of the Process Server shows that brother in law of the accused was
informed telephonically about the warrants issued against the accused.
In the opinion of the court, accused has knowledge about the pendency of the present case
and he is deliberately avoiding the process of law.
In view of the same, process U/s 84 BNSS (u/s 82 of Cr.PC) be issued against the
accused through DCP concerned on his last known address with the directions to execute the same at least
30 days before the date given. The process server is also directed to ensure the execution of the aforesaid
process by:-
1. The proclamation must be read in some conspicuous place of the town or village in
which the person resides.
2. It shall also be affixed to some conspicuous part of the house in which the person
resides or to some conspicuous place of the town or village.
3. A copy of the proclamation must also be affixed to some conspicuous part of the Court
house.
4. The process shall be duly published in the daily national newspaper.
Copy of the order be sent to DCP concerned alongwith process for perusal and
compliance alongwith a direction to ensure presence of process server, who executes process U/s 84 BNSS
(u/s 82 of Cr.PC), to remain present in person before the court on the NDOH for recording his statement.
A clear period of 30 days be given, after publication through above modes, to the accused
to mark his appearance before the Court.
Necessary publication charges to be filed by the complainant.
Put up for further proceedings on 24.12.2026.
