Arguments on charge on behalf of the accused heard.
Allegedly recovery is made from the accused Amit @ Mittu
and accused Manjeet @ Manni was arrested on disclosure of accused Amit
@ Mittu who disclosed that accused Manjeet has provided the arms to him.
Nothing is recovered from the accused Manjeet. Only link between the
accused Manjeet and Amit is CDR and CAF to show that both the accused
were in contact with each other. However, there is no other evidence against
accused Manjeet @ Manni. Prima facie, there is sufficient material on
record to frame charge against the accused Amit @ Mittu.
Accordingly, charge is framed against the accused Amit @
Mittu u/sec. 25/54/59 Arms Act and the same is read over and explained in
vernacular, to which the accused pleaded not guilty and claimed trial.
Prima facie there is no material on record to frame charge
against accused Manjeet @ Manni. He is discharged in the present matter .
Accused Manjeet @ Manni be released from judicial custody, if not needed
in any other matter.
Issue summons to PW ASI Pritam Chand and ASI Bharat Lal
Meena for NDOH.
