as per seizure memo Mark X which you retained in contravention of provisions of Arms
Act without any licence or permission and thereby you committed an offence punishable
under section 25/54/59 of Arms Act and within my cognizance.
I hereby direct that you be tried by this court on the said charge.

At the time of giving loan by the complainant he was having
cash in hand of Rs. 8 lacs to the accused. I have brought the documents i.e.
bank statement of the complainant from 05.12.2012 to 04.05.2013 Ex. CW-
1/D-1 and banaya receipt for sale of property by the complainant dt.
24.10.2014 Mark X. The complainant has withdrawn a sum of Rs.
1,75,000/- on 13.03.2013 and a sum of Rs. 2,30,000/- on 20.03.2013 for
giving loan to the accused. The loan was givn to the accused on 10.11.2014.
At the time of giving of loan complainant was doing the private job, his
annual income was about 3 lacs. ITR and salary slip of the complainant is
not filed on record.
Court Ques. When did accused approach the complainant for laon?
Ans. Accused approached the complainant for loan in November 2014.
The complainant did not file ITR as his income is not taxable. The
complainant is having two bank accounts. One in Synidicate Bank and I
do not remember the other bank account. I have filed the account statement
of Syndicate Bank. It is correct that Mark X is not notarised. It has the
stamp of the property dealer. It is correct that it does not have any receipt
number. Rs. 4 lacs for the property transaction were received in cash. I have

not filed any agtreement to sell or sale deed pertaining to the transaction as
per Mark X. VOL. later banaya agreement was canceled. I have cancelation
documents for the same. Same is Ex. CW-1/D-2 & Ex. CW-1/D-3 (OSR). I
had also given loan to the accused , however I do not remember the exact
date at this time but the loan amount of Rs. 2 lacs and it was given prior to
demonitisation and it was pending due during the period of demonitisation.
At the time of giving loan of Rs. 2 lacs I had not executed any document.
At that time, accused was paying regular interest to the complainant,
therefore, Rs 2 lacs were given by me to the accused as accused was my
neighbour. Rs 2 lacs were mentioned in the agreement dt. 11.11.2016
wherein total loan of Rs 10 lacs is shwon.
Court Ques. Does complainant have any money lending licence?
Ans. No.
Court ques. How much interest wa sbeing charged by the accused?
Ans. 2% per month.
It is wrong to suggest that complainant did not advance loan of
Rs. 8 lacs to the accused. It is wrong to suggest that complainant has no
proof for the same. It is wrong to suggest that accused has made payment to
me. It is wrong to suggest that since payment was made in demonitisation
in form of discontinued currency, there was a dispute between the parties. It
is wrong to suggest that complainant do not know accused and has never
met the accused. It is wrong to suggest that I am deposing falsely at the
instnace of the complainant.
