Present: Mr. Vaibhav, AR of the complainant in Court.
Matter is at the stage of consideration.
AR of the complainant submits that no other tracking report is available with
the complainant and that it seems that due to technical issue at the end of the postal
authority, and incorrect tracking report has been generated for the postal receipt of the legal
notice. He further submits that the correct postal receipt ID is mentioned on the tracking
report but the report is incorrect.
Perusal of the record shows that there is a discrepancy about the date of
dispatch of legal notice and the same is to be clarified for the purposes of proof of delivery
of legal notice.
Let summons be issued to the concerned clerk of Postal Authority/Post office
from which the complainant dispatch the legal notice in question on filing of PF by the
complainant to appear either through VC or physically with the relevant record to clarify
date of dispatch, date of delivery and the tracking report of the legal notice.
PF be filed within 15 days from today.
Postal witness is directed to send the relevant documents, or by way of email
on mmniactdc-north@ddc.nic and to appear through Video Confrencing via link
1769049636 or physically in the Court room no. 106, New Extension Building, Tis Hazari
Court, Delhi.
Copy of the cheque, return memo and this order be annexed with the summons.
