Submissions on the point of charge heard. Record perused.
Having heard the submissions and perused the record, I am of the
considered opinion that prima facie case for offence under Section 25 Arms
Act is made out against the accused.
Accordingly, charge for offence under Section 25 Arms Act is
framed against the accused to which he pleaded not guilty and claimed trial.
At this stage, accused has submitted that he is not disputing the
genuineness and veracity of the recording of case FIR No. 107/2024 dt.
23.05.2024, PS Crime Branch, as Ex. A-1, certificate u/s 65 B of Indian
Evidence Act, as Ex. A-2, FSL report bearing NO.
SFSLDLH/6536/Bal/675/24 dt. 20.08.2024 as Ex. A-3, sanction u/s 39
Arms Act dt. 23.10.2024 as Ex.A-4, DD No. 92 A & 94 A dt. 23.05.2024 are
Ex. A-5 & A-6 respectively.

His statement to this effect has been recorded separately
under Section 294 Cr.P.C. In view of the same, PWs ASI Bharat Lal,
Garim Sharma, Junior Forensic Assistant and SO to DCP crime are
dropped from the list of witnesses.
Put up for PE on 14.02.2025.
Issue fresh summons to PW HC Vikas Dabbas and HC Mandeep
for NDOH.
