Ms. Gurpreet Kaur, Ld. counsel for the accused.
Ld. counsel for accused has prayed for an oral exemption
on behalf of the accused. Allowed for today only subject to appearance
of accused on the next date of hearing.
Matter is at the stage of appearance of proposed accused
U/s 223 BNSS. The court is of the view that a case U/s 138 NI Act is
made out against the accused.
I take cognizance in the matter.
Following the law laid down in
A. C. Narayanan Vs. State of
Maharashtra & Anr.” (2014) 11 SCC 790, complaint, affidavit of evidence
and documents considered. In view of complaint, documents produced and
verification in the form of affidavit of evidence, there are sufficient grounds
for proceeding further against accused person for offence punishable under
Section 138 N. I. Act.
As the accused has appeared before the court formal
issuance of summons is dispensed with.
Ld. counsel for the complainant is directed to supply
copies of complaint and documents to Ld. Counsel for accused through
whatsapp no. (9871203770) within seven days.
Put up for grant of bail /framing of notice on 07.08.2025.
